Montana had a Special Needs ESA specifically for students with an IEP — until a court ruled it unconstitutional in December 2025. The state has appealed, and the program is currently in legal limbo. Families already using it can keep spending their remaining funds through June 30, 2026, but no new families can enroll while the case works its way through the courts.

In plain terms: if you were hoping to use Montana's ESA to help pay for a dyslexia tutor, that door is currently closed to new applicants, and it's genuinely unclear when or if it will reopen. Montana's dyslexia screening law itself (the Montana Dyslexia Screening and Intervention Act) is still fully in effect and requires schools to screen for reading risk using a properly trained screener, regardless of what happens with the ESA case.

Tutor and therapist pathways

The Montana Dyslexia Screening and Intervention Act (MCA 20-7-469) requires that dyslexia screening be administered by someone with real training to recognize signs of dyslexia, and directs the Office of Public Instruction to provide best-practice guidance to schools. There's no separate state-issued "dyslexia therapist" license. Private tutors need no state credential to operate; the national CALT, Barton, and Wilson standards apply.
